Terms of Service Agreement

By using this website, participating in our events or matchmaking service, you agree to the following terms and conditions.

First Class Singles, Inc. (hereinafter First Class Singles) provides its services to you subject to the following Terms of Service ("TOS"). In addition, when using specific First Class Singles services, you and First Class Singles will be subject to any guidelines or rules applicable to these services which First Class Singles may communicate to you or post from time to time. These guidelines or rules shall be deemed part of the ("TOS").

Scope of Services

First Class Singles currently provides members with individualized services designed to provide introductions to other single members via personal introductions, direct contact from other members via online profile listings and through member participation at singles events. (the "Service") as well as invitations to other amenities tailored to the clients needs, at an additional fee. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including any new First Class Singles services, will be subject to the ("TOS").

Description of Matchmaking Service

If the personal matchmaking membership is purchased, we will attempt to find a match for you from our current client base when we receive your information and photos. Once we have a match for you, we will send a letter or e-mail to you and our other member with your first name, age, city, state, occupation, public e-mail address and public telephone number that you provide to us. All male members of our matchmaking service must pass a background check by our licensed detective. We request that all male members be the first to initiate contact. If requested, women will have to pass a criminal background check by our licensed detective before meeting another member.

Description of Event Service

First Class Singles holds events for single adults designed to facilitate social interaction and communication.

First Class Singles does not screen participants registering for events. By registering for a First Class Singles event, you are agreeing that First Class Singles nor any of its partners is liable for any damages, direct or indirect, that may in any way arise out of attending a First Class Singles event. This includes, without limitation, damages arising out of meeting or communicating with other participants in events sponsored by or affiliated with First Class Singles, Inc.

First Class Singles, may adjust the age ranges to ensure a balance of men and women in attendance.

Description of Online Profile Listing Service

First Class Singles allows members to post profiles on our website subject to our approval. First Class Singles does not screen participants registering for online profile listings unless indicated. However, First Class Singles requires all members wanting to initiate contact to pass an ID Verification and Criminal background check by Trufina.com. We are not responsible for any problems with the Trufina system that may result in a member becoming approved when in fact they should not be approved or breach of your private information as a result of using Trufina.com

You understand that you are undertaking the Trufina process at the request of First Class Singles and that certain outcomes of this process may preclude you from membership in First Class Singles. Specifically: if your identity cannot be verified; or if your criminal record contains infractions more serious than typical traffic violations, then you are not be eligible for membership in First Class Singles. If you fail the Trufina ID verification and/or criminal background check, First Class Singles will not grant you membership and a processing fee of $10 will be held from your refund.

First Class Singles is not responsible for any incorrect or inaccurate Content posted on our website, whether caused by members of the First Class Singles or by any other means including, but not limited to unauthorized access. First Class Singles is not responsible for the conduct, whether online or offline, of any user of the Website or Member of the Service. First Class Singles assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or Member communications. First Class Singles is not responsible for injury or damage to users and/or Members or to any other person's computer related to or resulting from participating or downloading information or images in connection with using our website and/or in connection with other services. Under no circumstances will First Class Singles be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Website or the Service, any Content posted on the Website or transmitted to Members, or any interactions between users of the Website, whether online or offline. The Website and the Services are provided "AS-IS" and First Class Singles expressly disclaims any warranty of fitness for a particular purpose or non-infringement

First Class Singles will not be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits arising from your use of the website or the Service, even if First Class Singles has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, First Class Singles' liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to First Class Singles for the Service during the term of membership.

As the account holder, you are responsible for all activity on your account. It is important that you not reveal your password to anyone. You agree not to reveal your password to other users and you agree to indemnify and hold First Class Singles harmless for any improper, illegal or unauthorized use of your account. This includes illegal or improper use by someone to whom you have given permission to use your account.

First Class Singles does not assume any responsibility or liability for content, text, communications, images, and other information provided that is provided by other members. First Class Singles reserves the right to remove content that does not meet our standards. But we are not responsible for any failure or delay in removing such content. By submitting or posting content there, you are representing that you are the owner of such material or have authorization to distribute it.

Your membership in allows you to send and receive e-mail to and from other members. This does not mean that you may use First Class Singles to send unsolicited bulk e-mail or junk e-mail or cause unsolicited bulk e-mail to be sent by someone else.

Unsolicited bulk e-mail is strictly prohibited.

Unsolicited advertising is not allowed. This includes the sending of bulk e-mail.

You may not use any area of First Class Singles to harvest or collect information, including screen names and email addresses. The use of such information for the purpose of sending unsolicited bulk e-mail or advertising is strictly prohibited.

Any violation of these provisions can subject your account to immediate termination and further legal action. First Class Singles also reserves the right to take any and all legal and technical remedies to prevent unsolicited bulk e-mail from entering, utilizing or remaining within our network.

You must not copy, transmit, modify, distribute, show in public or in private or create any derivative works from any of the content you find on First Class Singles, unless you have the legal right to. Making unauthorized copies of any content found on First Class Singles can lead to the termination of your account and may even subject you to further legal action beyond the termination of your membership. Similarly, other content owners may take criminal or civil action against you. In that event, you agree to hold harmless First Class Singles and its subsidiaries, affiliates, related companies, employees, officers, directors and agents.

You will be considered in violation of the Terms of Service if you (or others using your account) do any of the following:

Post, transmit, promote, or distribute content that is illegal.

Post, transmit, promote, distribute or facilitate distribution of content intended to victimize, harass, degrade or intimidate an individual or group of individuals on the basis of age, disability, ethnicity, gender, race, religion or sexual orientation. Hate speech is unacceptable anywhere on the service.

Attempt to get a password, other account information, or other private information from a member. Violations of these terms may result in the termination of your membership.

Upon a request by First Class Singles, you agree to defend, indemnify and hold harmless First Class Singles and its affiliated subsidiaries, employees, contractors, officers, directors, telecommunications providers and content providers from all liabilities, claims and expenses, including attorneys fees, that arise from a breach of this Member Agreement for which you are responsible or from the use of First Class Singles or the Internet, or in connection with your transmission of any Content on First Class Singles. First Class Singles reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by a Member. In that event, the member shall have no further obligation to provide indemnification for First Class Singles in that matter.

1. MEMBER DISPUTES

You are solely responsible for your interactions with other First Class Singles members. First Class Singles reserves the right, but has no obligation, to monitor disputes between you and other members.

2. DISCLAIMER OF LIABILITY

First Class Singles is not liable to the users of the Service for the conduct of or information provided by the other members of First Class Singles or responsible for any damage to a person, arising in a manner out of the use of the Service. The users and members acknowledge that they assume all risk and or responsibility for any loss, damage, death or personal injury arising from the use of the Service or as a result of our negligence.

Although we strive to provide you with quality people, we cannot be held responsible for the actions of other members, any criminal background information that we do not know or false statements given to us by other members. By using First Class Singles, you agree to release First Class Singles and its owners from any liability associated with transactions, communications and meetings that occur between you and any individual with whom you may meet or communicate as related to an introduction by First Class Singles, Inc. You agree that First Class Singles shall not be held liable for any indirect or direct damages including, but not limited to property damage, emotional distress or bodily injury arising from using the services provided by First Class Singles, Inc.

Although we follow strict policies and regulations to ensure that all of your personal information is kept private and secure, you agree that First Class Singles, Inc. will not be held liable for consequences resulting from interception, theft, or other unintentional release of your information. Using the services of First Class Singles, Inc. is at your own risk.

You agree to defend, indemnify and hold harmless First Class Singles, Inc. and its owners from and against any and all lawsuits, losses, damages, claims, liabilities, expenses that First Class Singles may occur as a result of your use of our services, breech of this agreement by you, your negligence or misconduct.

3. PRIVACY

First Class Singles will not share any information about you without your prior specific written consent other than in connection with the Service. Any information you give us that is not for display to members will be kept strictly private.

First Class Singles will not sell or otherwise share your name, e-mail address, or other personal information with any other business or marketing campaign without your permission, during time of service as well as after service contract is completed. However, First Class Singles reserves the right to partner with other companies and share your information for the sole purpose of matchmaking, dating services or singles events.

Any email sent to First Class Singles or another First Class Singles Member using the message forms on FirstClassSingles.com is subject to review by First Class Singles for administrative and/or security purposes.

4. CONDUCT

As a members, you agree that:

You are solely responsible for your conduct and for the information you provide to First Class Singles or transmit to other members.

You will not transmit to other members or employees any defamatory, inaccurate, abusive, profane, offensive sexually oriented, threatening, harassing, racially offensive, illegal material, or any material that infringes or violates another party's rights (including but not limited to, intellectual property rights, and rights of privacy and publicity). Please notify First Class Singles in writing about conduct or material from other members which you believe infringes these rules.

You will use the Service in a manner consistent with any and all applicable laws and Regulations

You will not impersonate any person or entity.

You will not "stalk" or harass any person.

You will not express or imply that any statements you make are endorsed by First Class Singles, without First Class Singles' specific prior written consent.

You will not harvest or collect personal information about other members, whether or not for commercial purposes, without their express consent.

5. YOUR REGISTRATION INFORMATION MUST BE ACCURATE, CURRENT AND COMPLETE

In consideration of your use of the service, you agree to provide true, accurate, current and complete information about yourself as prompted by our profile form and registration data and maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, First Class Singles has the right to suspend or terminate your membership and refuse any and all current or future use of the service.

We strive to provide our members with the best service and introduce them to quality people that are seeking a meaningful relationship. Due to these high standards, your membership will be terminated if you do not act politely and ethically to all members. Behavior that will result in the termination of your membership includes, but is not limited to: behavior complaints by other members, canceling a meeting with another member without giving advanced notice, deceptive or aggressive behavior toward other members and falsifying information during your interview or on your application.

You guarantee to First Class Singles, Inc. that you are single, legally divorced, separated or widowed. You are in a healthy state of mind and body, aged 18 or over, and free of any criminal record. Your application is true and accurate and you will promptly notify First Class Singles, Inc. of any change in the information submitted.

6. ACCESS, PASSWORDS AND SECURITY

You will be responsible for the confidentiality and use of your membership access number(s), password(s), and account number(s). You will be responsible for all electronic communications, including account registration and other account holder information, e-mail, financial, and other data ("Electronic Communications") entered through or under your access number(s), password(s) or account number(s). First Class Singles will deem any electronic communications it receives under your access number(s), password(s) or account number(s) as having been sent by you. You agree immediately to notify First Class Singles if you become aware of any loss or theft or unauthorized use of any of your access number(s), password(s) and/or account number(s)

7. FIRST CLASS SINGLES PROPRIETARY RIGHTS

You acknowledge and agree that the Service contains proprietary and confidential information which is protected by applicable intellectual property and other laws. You further acknowledge and agree that content contained in sponsor advertisements or information presented to you through the Service or by advertisers is protected by copyright, trademarks, service marks, patents or other proprietary rights and laws. You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service, in whole or in part. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

8. TRADEMARK INFORMATION

Any First Class Singles trademarks, service marks, logos , product and service names are marks of First Class Singles( the "First Class Singles Marks"). You agree not to display or use the First Class Singles Marks in any manner without the owner's express prior written permission.

9. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT

FIRST CLASS SINGLES MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM FIRST CLASS SINGLES OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT STATED IN THE ("TOS").

WE RESERVE THE RIGHT TO DENY ANYONE MEMBERSHIP OR PARTICIPATION IN OUR EVENTS FOR ANY REASON. NOT ALL MEMBERS WILL QUALIFY FOR ALL OF THE SERVICES OFFERED BY FIRST CLASS SINGLES, INC. MEMBERSHIP DOES NOT GUARANTEE THAT FIRST CLASS SINGLES WILL FIND YOU A SUITABLE RELATIONSHIP OR INTRODUCE YOU TO THE PERSON YOU ARE SEEKING. THE NUMBER OF MATCHES YOU RECEIVE DEPENDS ON THE FLEXIBILITY OF YOUR CRITERIA EVEN THOUGH THERE IS NO EXPRESS OR IMPLIED WARRANTY THAT A RELATIONSHIP CAN OR WILL BE FOUND. YOUR RESULTS WILL VARY. MEMBERSHIP SERVICES INCLUDING, BUT NOT LIMITED TO ONLINE PROFILE LISTINGS, MATCHMAKING SERVICES, BACKGROUND CHECKS, LIMOUSINE, CONCIERGE, IMAGE CONSULTING AND PHOTOGRAPHY SERVICES ARE NOT REFUNDABLE.

WE WILL ISSUE REFUNDS FOR EVENTS UNDER THE FOLLOWING CONDITIONS: THE EVENT IS CANCELLED OR YOU CANCEL YOUR RESERVATION WITHIN 72 HOURS OF THE EVENT.

10. TERMINATION OF THE SERVICE

You agree that First Class Singles, in its sole discretion, may terminate your password, membership account (or any part thereof) or use of the Service, if the First Class Singles believes that you have violated or acted inconsistently with the letter or spirit of this agreement. You agree that any termination of your access to the Service under any provision of the TOS shall be effective upon notice to you, and acknowledge account and agree that thereafter First Class Singles may immediately deactivate or delete your membership account and all related information of your access to the Service; provided, however, that if the termination is unrelated to your acts or omissions First Class Singles will refund the pro rata portion of any fee that may have been paid by you for the portion of the Service not furnished to you as of the date such termination.

11. LINKS

The service may provide, or third parties may provide, links to World Wide Web sites or resources. Because First Class Singles has no control over such sites and resources, you acknowledge and agree that First Class Singles is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that First Class Singles shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

12. NOTICES

Notices to you from First Class Singles may be made by either e-mail or regular mail. First Class Singles may provide notices of changes to the TOS, modification or termination of the Service or other matters by e-mail to you or displaying notices or links to notices to you on the our website.

13. MODIFICATIONS

The ("TOS") may be modified First Class Singles from time either by posting the modifications on our website or by notice to you. Your acceptance of modifications will be indicated by your continued use of the Service after the modification(s) effectiveness.

14. GENERAL PROVISIONS

The ("TOS") constitutes the entire agreement between you and First Class Singles and governs your use of the Service, superseding any prior agreements you and First Class Singles with respect to the subject matter contained in the ("TOS"). The ("TOS") may only be modified or amended as set forth above or otherwise in a writing signed by First Class Singles and you. The ("TOS") and the relationship between you and First Class Singles shall be governed by the laws of the State of New Jersey without regard to its conflict of law provisions. You and First Class Singles agree to submit to the personal and exclusive jurisdiction of the courts located within New Jersey. The failure of First Class Singles to exercise or enforce any right or provision of the ("TOS") shall not constitute a waiver of such right or provision. If any provision of the ("TOS") is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the ("TOS") shall remain in full force and effect You agree that regardless of any statute or law to the contrary, any claim of cause of action arising out of or related to use of the Service or the ("TOS") must be filed within one (1) year after such claim or cause of action arose or be forever barred. The Section titles in the ("TOS") are for convenience only and have no legal or contractual effect.
